1. Agreement to Terms

By accessing and using Rove Mode (the "Service"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use the Service.

In addition to these Terms of Service, you must read, understand, and sign the following required documents before using our Service:

• Safety Waiver - Required acknowledgment of risks associated with indoor cycling
• Studio Policy - Rules and guidelines for using our services, including attendance, cancellations, and account management

These documents are incorporated by reference into these Terms of Service and form part of your agreement with Rove Mode. You will be required to sign both documents before booking classes or using certain features of the Service.

2. Use License

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use. You agree not to:

• Reproduce, duplicate, copy, or sell any portion of the Service
• Attempt to gain unauthorized access to our systems or networks
• Transmit viruses, malware, or any harmful code
• Use automated tools to scrape or collect data without permission
• Harass, abuse, or threaten other users
• Violate any applicable laws or regulations
• Reverse engineer or attempt to derive source code

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate information and notify us immediately of any unauthorized use of your account.

4. Intellectual Property Rights

The Service and all content, features, and functionality (including but not limited to software, text, graphics, images, and logos) are owned by Rove Mode, its licensors, or other providers of such material and are protected by copyright, trademark, and other intellectual property laws.

5. User-Generated Content

You retain ownership of any content you submit to the Service. By submitting content, you grant Rove Mode a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, display, and distribute your content for the purpose of providing the Service.

6. Classes and Credits

Class credits are non-refundable and non-transferable unless otherwise stated. Credits expire according to the terms of your purchase. We reserve the right to adjust credit policies at our discretion with notice to users.

All classes and services are subject to our Studio Policy, which governs attendance, cancellations, no-shows, and other class-related rules. By booking a class, you agree to comply with the Studio Policy.

7. Cancellation and Refunds

Please refer to our Refund Policy for detailed information about cancellations and refunds.

Cancellation policies, including deadlines and credit refund eligibility, are detailed in our Studio Policy. By booking a class, you agree to these cancellation terms.

8. SMS Communications

By opting in to SMS notifications, you consent to receive text messages from Rove Mode related to class reminders, booking confirmations, schedule changes, cancellations, and other service-related updates.

• Consent is not required to purchase credits, book classes, or use any other feature of the Service.
• Message frequency varies based on your class activity; typical users receive 2-6 messages per month.
• Message and data rates may apply depending on your mobile carrier and plan. Rove Mode does not charge for SMS messages.
• To opt out, reply STOP to any message at any time, or update your preferences in Settings → Notification Settings.
• For help, reply HELP to any message, or contact us at info@gorovemode.com.

Your phone number will not be sold, rented, or shared with third parties for their own marketing purposes. Phone numbers and SMS consent records may be processed by third-party messaging providers solely for message delivery. 9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ROVE MODE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Assumption of Risk and Safety Waiver

Indoor cycling involves inherent risks, including but not limited to physical injury, illness, or death. You assume all risks associated with participating in classes using our Service. Before starting any exercise program, consult with a healthcare provider. We recommend proper bike setup and technique instruction before use.

By using the Service, you acknowledge that you have read, understood, and signed our Safety Waiver, which contains important information about the risks of indoor cycling and releases Rove Mode from liability for injuries or damages that may occur during your use of the Service.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12. Indemnification

You agree to indemnify and hold harmless Rove Mode from any claims, damages, or costs (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Modification of Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of the Service following any modifications constitutes your acceptance of the new Terms.

14. Termination

We reserve the right to suspend or terminate your account and access to the Service at our discretion, without notice or liability, for conduct that violates these Terms, the Studio Policy, or is harmful to other users.

Account suspensions, strikes, and bans are governed by our Studio Policy. Violations of the Studio Policy may result in temporary suspension or permanent termination of your account, as detailed in that document.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of Texas, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Kyle County, Texas.
